Updating Your Clients’ Estate Plan in 2020

Program Description:

Identifying items that need to be updated on old or incomplete estate plans including trust division and spousal portability at the first death, basic long term care issues. Working to reduce income tax exposure in the second trust created at first death and trust for the benefit of both minor and adult children. Introduction to distributions to non-spouse beneficiaries of retirement plans with Secure Act basic 10-year rule.

Replacing Bypass trusts with Marital QTIP trust and or Spousal Portability Election

Planning around Changing estate exemptions

Structuring Irrevocable trusts like children’s trust as Unitrusts to get a larger share of income and capital gain income out to beneficiaries in lower marginal tax brackets.

Planning for step-up in tax basis

Dealing with Definition of Incapacity of trustee

Key issues in ancillary documents like Advance health care directive, Power of attorney for property and wills

Speaker biography:

Paul Cheverton is an attorney whose office is in Del Mar Heights.  His legal practice emphasizes estate planning including trusts and lifetime gift planning to help families reduce their estate tax exposure. 

Paul often provides estate and gift tax planning and trust income tax planning continuing education to CPAs.

Paul has an A.B. from Stanford University, a J.D. from the University of Southern California, and an LL.M. in taxation from the University of San Diego.  He has been practicing law since 1983 and doing primarily estate planning and trust administration since 1990.
